A domain name dispute between Fortune 500 companies such as Robert Bosch Co., Ltd. and Zhejiang Sensen Automotive Parts Co., Ltd. has seen many world-famous companies that are caught in the domain name see hope. It is understood that as early as June 1997, Bosch registered the BOSCH trademark in the Trademark Office of China's State Administration for Industry and Commerce. On September 10, 1998, the domain name bosch.com.cn was registered and the corresponding website was opened. Zhejiang Sensen Automotive Parts Co., Ltd. registered the domain name bosch.cn on March 17, 2003 in Xiamen Jingtong Technology Industrial Co., Ltd. The main part bosch in this domain name is identical to Bosch's trademark BOSCH/bosch in terms of pronunciation, letters, and sequencing.
Acting on behalf of this case, Beijing Dianfu Law Firm's lawyer Ding Futang introduced that on February 9th this year, Robert Bosch Ltd. entrusted Jia Jia to the China International Economic and Trade Arbitration Commission's Domain Name Dispute Resolution Center to file complaints against the bosch. Cn's domain name does not enjoy any rights and legal interests and is a malicious cybersquatting and should be transferred to the complainant Robert Bosch GmbH.
The panel of experts of this case finally determined that the behavior of the respondent had already constituted malicious registration or use of the domain name. The complainant filed a complaint based on the complainant's registration of the disputed domain name bosch.cn, and the disputed domain name should be transferred to the complainant.
Dai Futang told reporters that the revised "China Internet Information Center Domain Name Dispute Resolution Measures" has clearly defined the malicious registration: "The purpose of registering a domain name for selling or renting is no longer a criterion for judging the bad faith, and the registrant only has a civil interest. The owner's complainant or competitor sells, leases, or otherwise transfers the domain name to obtain an improper benefit to be defined as a bad faith registration." Well-known companies need to register and protect their domain names in advance to avoid unnecessary trouble caused by other companies or individuals.
